Data Subject Rights - Third Party End Users

Optimizely, Inc. and our subsidiaries and affiliates ("Optimizely", “we”, or “us”) believe in respecting your privacy. As part of this responsibility, we let you know through our Privacy Policy what information we collect when you interact with Optimizely.

We also provide various services for our customers to use on their own websites, apps and digital products. Our services allow customers to analyze and personalize the experiences and content they deliver through these products. This document, which is part of our Privacy Policy, summarizes our services and the steps we take to help keep your personal information protected.

1. How Our Services Works

Some Optimizely Services use cookies (a small text file containing a string of alphanumeric characters and data), local storage objects, and/or similar technologies to help our customers analyze and personalize their websites, apps and digital products. Cookies are set by our customer’s website domains and sometimes from our own log subdomains.

2. What Information Is Collected

The information our customers collect using Optimizely Services depends on each customer’s usage and settings. Generally speaking, the data collected by the Optimizely Services includes: event data (for example, whether a link is clicked or a page is viewed), user agent data (basic device information, such as browser and OS versions), domain URLs (such as URLs for referring / exit pages), information about experiments and personalization campaigns (for example, an ID number for the variation a visitor sees), Internet Protocol ("IP") addresses, and similar technical and usage information. This data may be associated with a numerical identifier (for example, for our website experimentation platform, a randomly generated cookie ID).

Our customers can enhance the data in the Optimizely Service by providing us with additional information about their visitors, but our online Terms of Service currently prohibit our customers from sending us most personal information about their visitors).

We also offer our customers various tools to help them control the information they collect when using our services. A method known as IP masking or IP anonymization, for example, gives our customers the option to tell us to store only a portion of an IP address, rather than the entire address.

3. Where Information Goes

Because most of our services are cloud-based, the information our customers collect when using the Optimizely Services will be transferred to Optimizely-managed computers, which are currently located in the United States. We also use third-party service providers to assist us in providing our services, and we may transfer information to these companies for storage and processing.

4. Your Choices

Choices Offered by Customers. Our customers control their websites, apps and digital products, the Optimizely Services they choose to use, the configurations and settings for those services, and the type of data passed to us. Please condult the privacy policies and disclosures for these websites and products to find out more about the information being collected and your related choices. We are not responsible for the privacy or security practices of our customers, which may be different than our own Privacy Policy.

Optimizely’s Opt-Out Tool. If a website is using Optimizely and you wish to opt out, you can use the tool below to tell the Optimizely code on that domain to set an opt-out cookie on your browser. The cookie is designed to prevent you from being placed in future Optimizely experiments on that domain. This cookie will also prevent that website from making any Optimizely tracking calls for your visit.

To use the tool, copy the URL of a webpage running the Optimizely script into the following input field, then click on the generated link. The tool appends a query parameter (optimizely_opt_out=true) to the website's URL, which issues a special command to set the opt-out cookie for that domain.

If it worked, you will receive a notice stating that you have opted out of Optimizely experiments on that domain. If you have trouble getting it to work, you can contact us at help.optimizely.com.

Please note that this tool, like others, relies on cookies to work, so you will need to opt-out on each browser you use, and clearing cookies on that browser will also clear the opt-out cookie(s). Also note that the tool does not delete previously-placed cookies; you will need to use your browser settings to do so.

Other Options. Most Internet browsers automatically accept cookies, but some browsers may permit you to change your settings to disable or delete cookies and other tracking tools. Please refer to your browser’s or mobile device’s technical information for instructions on how to use these features. Should you want further control over cookie placement, there are several browser extensions that permit you to control what cookies are placed on your browser and that help you control tracking. Please note that these browsers and extensions are made by third-party companies, not Optimizely, so Optimizely is not responsible and cannot provide technical support for these products. Also, you should keep in mind that some sites and services (or their features) may not work for you if you delete or disable cookies and similar technologies.

5. Privacy Shield and Data Requests

Optimizely, Inc. adheres to the principles of the EU - U.S. and Swiss - U.S. Privacy Shield frameworks with respect to personal data (if any) submitted by our customers to Optimizely in reliance on Privacy Shield. Further information about our participation can be found in our Privacy Policy.

Optimizely acknowledges that EU and Swiss citizens have certain rights under applicable data protection laws providing for the access, correction and/or erasure of personal data in certain circumstances.

As noted above, when Optimizely’s customers use the Optimizely Services as part of their own websites, apps and digital products, each customer retains control these products and remains responsible for handling privacy requests from its users. If you are a user of one of our customers’ websites or products, and you would like to place a request for access, correction or deletion of personal data collected on that website or product, you should direct your request to the applicable customer. Optimizely cannot fulfill these requests.
